Boehner said on the Senate floor that if Republicans are going to "be remembered for something," they will be known for their efforts to eliminate the "loophole and stop the president from going after people with very different opinions than his own" and passing comprehensive tax reform. Boehner acknowledged the impact this provision has on individual Americans. "They're the ones who are going to be paying for it," Boehner said. "Our goal is to be the party that will be remembered for something for the next two years." He later added, "All Republicans believe that we should have all Americans paying their fair share in taxes. But this provision may be the only one of its kind in our nation's history that will allow people to avoid paying taxes who claim to believe we should have no tax increases whatsoever."

Nevada Department of Human Resources that the constitutionality of a portion of the Tax Cuts and Jobs Act of 2017 was ripe for judicial review. The court ruled that the plaintiffs (six states) were likely to succeed on the merits of their claim that the tax credits provided by that section of the Act were unconstitutional. The court issued a stay of the effective date of the law so that the plaintiffs can present their claims in federal court.
